Whether you are filing a family petition to your spouse, or removing the conditions on your residency, one of the requirements of the process is to prove to USCIS that your marriage is bona fide. A lie perpetuated by Hollywood, and many of the Latino television networks, is that immigration officers are going to come to your home to verify your marriage. Thats not true. The marriage must be proven in a documentary way and through the interview carried out by the immigration officer.
One of the simplest ways to prove the truth of your marriage is with the children you have together. If there are children in common, the family petition process becomes much simpler. In the event that there are no children in common, it is necessary to prove to the officer that the couple lives in the same residence. There are several ways to prove that the couple lives under the same roof.
You could present the documents of the lease of the house, or of the ownership of the house in both names; presentation of utility payments, such as electricity, gas, light, cable, internet, among others; could help you reinforce your process.
One of the most important aspects to demonstrate is the union of material goods, so evidence of joint bank accounts, credit card accounts, loans, mortgages, among other financial instruments, could be presented. Another way to prove the veracity of the marriage is through photos. I advise many of my clients to prepare a photo album that includes photos in different places, as well as photos of the wedding, and photos with friends in different locations. This is especially important because many immigration officers ask who the people in the photos are, and both the applicant and the petitioner must be able to identify them.
Finally, it is especially important to answer all the corresponding questions on the day of the interview. A lot of my clients get nervous, but the reality is that if the couple is real, the questions being asked are pretty simple, and both spouses need to know the answers. Most importantly, and I warn everyone, if for some reason you dont know the answer, dont lie, and simply say you don't know the answer or dont remember it. Lying to an immigration officer can seriously affect your process. On one occasion, one of my clients forgot the wedding date during the interview. The immigration officer understood, and the case was approved; however, my clients spouse was not as benevolent as the officer.
