In today's blog we are going to be talking about the amount of money you need to have to start a bankruptcy in the State of Florida. To file a bankruptcy petition in court, it is necessary to include, in conjunction with the bankruptcy petition, the filing fee. Depending on whether you are filing Chapter 7, 11, or Chapter 13 Bankruptcy, filing fees may vary. For Chapter 7 bankruptcy, the filing fee is $335, for Chapter 13 the filing fee is $310, and for Chapter 11 the filing fee is $1,717. If, for any reason, you are unable to pay this amount in full, you can request to the court, showing the appropriate reasons, to pay the filing fee in two equal payments. One of the requirements for filing a bankruptcy petition is that the debtor must complete a credit counseling course before filing the process and continue it after the filing. Depending on where you take the course, the amount to be paid will differ. I generally recommend that my clients take the course online, and it can cost between $25- $30. If you are going to file a Chapter 13, you have to keep in mind that in Chapter 13 there is a payment plan, so it is necessary that you have the money to be able to keep up with your monthly payment. If a mortgage modification is to be made through the MMM plan, you will need to have at least 31you’re your monthly income available to make the plan payments.
